If you second home is in a vacation spot or a resort you should be aware of the effect of seasonality on the marketplace.  It may be busy during one part of the year and deadly quiet at other times.  Therefore plan out carefully when the best time to list your home will be.  You will want your home to look its best and so if its snow season it may not be the best time to show it to full advantage.  Also there may be different groups of buyers at different times.  A cabin may attract families during the summer and hunters in the fall.

Families may be in a position to buy a vacation home after the New Year when year -end bonuses have been paid out.  However if you are moving to the sun belt – summer may not be the best time to list your property because of the heat and lack of visitors.

It may be a good idea to take your property off the market during the quiet time of the year – so that you can rent it out and maximize your income potential.

Once you list your vacation property you must decide what you are going to do with the furniture.  Will you be leaving it?  If so it may help the home to be sold as it gives a picture of how it will look when its being lived in – or you can get your home staged to attract buyers.  The way it looks should always be aimed at the prospective buyers that will be there during the peak season.  Even if its during fall it may be beneficial to have a crystal clear pool on the property. This helps to establish an emotional bond between the prospective buyer and the home.

American buyers beware! Beware of foreign or US clients that have significant foreign operations. Be mindful of the Foreign Corrupt Practices Act. Better known as the FCPA. The Department of Justice alongside with the Securities Exchange Commission (SEC) in 2002, significantly began enforcing the FCPA very aggressively. The FCPA lay dormant since its inception in 1977. The intention of the Act is to prevent the bribery of foreign officials. It strictly prohibits and punishes the explicit actions of giving any official of a foreign country anything of inherit value. Especially if the giver’s intentions were to influence the placing and retaining of a business.

FCPA requires all companies to maintain accurate controls with their bookkeeping and records of all dealings with foreign countries and to adhere to FCPA’s regulations by creating internal controls designed to detect and stop any illicit payments. Any violations of these regulations will be punishable with a very exacting civil penalty or criminal penalty, maybe even both. Plus, there will be a greater penalty for a company who is dependent of the US government awarding contracts and they will forever become ineligible to enter into them.

It’s important to recognize the warning signs or the red flags of a potential FCPA violation. A company now needs to have due-diligence and know how to negotiate tactics to lessen the risks of doing business globally. A good example of this is a client of a company is operating in a country that lacks in compliance to FCPA regulations or that only recently has passed a comparable statute, or this client operates in a country that is known for its corrupt practices, or the client once ran afoul of the FCPA in the past and has corrected their issues, but poorly due to the misconduct of an employee and the employee is still employed. These are all red flags.

Other warning signs, which have nothing to do with the FCPA, would be the absence of a code of ethics, a reluctance to work with due diligence or a refusal to comply with future statutes. It is of extreme importance that all US companies dealing internationally understand and implement all FCPA regulations or the consequences will be grave, starting with the directors all the way down to the individual employees.

Financial institutions are not only advised to practice due diligence, but now in the United States they are required to do so by laws enacted by the FCPA, Foreign Corrupt Practices Act. This has served not only to protect the institutions themselves, but has also resulted in the investigations into acts of terrorist financing and other cases of fraud and corruption.  In the corporate world, all barriers have been removed as well.  This serves to give the public easy and free access to all the information surrounding the companies with whom one is dealing with, or supporting.

It also provides the means for those companies to defend themselves if they are called upon to do so.  When everything is out in the open, with nothing to hide, innocence is just as detectable as guilt.  The same holds true in the political realm.  As officials are being held more accountable for their actions today, the lack of privacy is really a good thing.  It is good, obviously for those who are doing nothing wrong, illegal or unethical.  It ensures that those the public supports–to support them, are worthy of that kind of loyalty.  The policies of the FCPA, are just set to keep it real, and to keep it honest.

Well I have done it! I signed the contract to teach English as a second language, ESL in Thailand for an eight month period of time. I’ll be leaving in the spring of next year so I will have plenty of time to get everything in order and prepare for the years leave from home. I plan on tacking two months more time on at the end so I can spend some time seeing the country and travel around before coming home. Thailand is the land of smiles and the Thai people touted by many travelers as the friendliest people in the world. I am really looking forward to the experience to be submersed n another culture and language for that long a period of time. But more importantly is the preparations at hand.

Other than wardrobe for such a hot and humid climate and other obvious things. I am need to figure out what to do with my house. I would need to rent it out for the year I will be gone, however am not fond of the idea of meeting with, screening and ultimately selecting tenants. This is not my forte. Besides if I did that I would need to be prepared to be out of my house before I was needing to leave for Thailand. Researching for a property management company I came up with Transglobe property management. I’m thinking that this will be the way to go. Turning the property over to them as I leave for Thailand and let them handle the details. Next step see what I can find on Transglobe property management with the Better Business Bureau. Once done with that set up an appointment to discuss my needs. And with that done a load will be off my mind and focusing on the rest of the issue brought up by leaving the country for a year could be handled.
