This is what is referred to user generated media , social sites such as My Space, Facebook, and Twitter. And the individual blogs that people create to express themselves. This is not only true for the project at hand, but the manager will have the foresight to see the needs, and create the plans for the next project in the works as well.  The manager will ensure that the team is provided with all that they need, the resources and the information that they will need to perform those tasks successfully.  The manager will have the authority in some cases to acquire information that the members of the team need, it is a job that often times, they are the only ones who can do that.  A great manager is a great team leader, and encourages everyone on the team to work in creative and collaborative ways.  This will ensure that all runs smoothly, and that not only are the goals of today achieved, but those of tomorrow as well.

I have worked in the service industry for many years, mainly in the restaurant business.  I have witnessed great cases of customer service, and not so great.  What I have noticed through waiting on people, is that the kindest gestures often hit the customers unaware, they get side swiped and before you know it, everyone has tears in their eyes.  Now, every customer is different, and knowing when to leave someone in peace to eat their meal, well, their body language will say it all.  But for the most part, people do want to engage in conversation, dining out is an experience after all.  One such occasion took place a few years ago when I was working in a high end steak house.

An older couple came in and I waited on them.  Their son was a sergeant in the US Army and he had just come home from a two year tour in Iraq.  They bought him a gift certificate and told me to wait on he and his wife when they came in.  A few days later, they were sitting in my section.  They enjoyed a great dinner, a little wine and a wonderful desert.  The restaurant manager would often take a dessert or an appetizer off of the bill for the soldiers who had returned from war.  I questioned him before I brought their check, and he took off everything.  Their entire meal was on the house.  I brought their check to them, which now totalled zero.  I left the check on the table and went to help another table.

When I came back, they looked at me with confusion written all over their face.  And this soldier said with tears in his eyes, “thank you”.  And wouldn’t you know, tears welled up in my eyes and I had a hard time getting out the words, “no, thank you”.  Now, that restaurant is a large corporation, and we were constantly barraged with secret shoppers trying to find us doing something wrong.  When I waited on that sergeant and his wife, I know I didn’t say things in “right” order, I may have left out an ingredient in the nightly special, but when no one was looking, my manager allowed me to go above and beyond the corporate and the scripted way in which were were to act, to wait tables.  This is what Steve Barbarich expects, and what all great owners should expect, managers and employees that take the extra step.

American buyers beware! Beware of foreign or US clients that have significant foreign operations. Be mindful of the Foreign Corrupt Practices Act. Better known as the FCPA. The Department of Justice alongside with the Securities Exchange Commission (SEC) in 2002, significantly began enforcing the FCPA very aggressively. The FCPA lay dormant since its inception in 1977. The intention of the Act is to prevent the bribery of foreign officials. It strictly prohibits and punishes the explicit actions of giving any official of a foreign country anything of inherit value. Especially if the giver’s intentions were to influence the placing and retaining of a business.

FCPA requires all companies to maintain accurate controls with their bookkeeping and records of all dealings with foreign countries and to adhere to FCPA’s regulations by creating internal controls designed to detect and stop any illicit payments. Any violations of these regulations will be punishable with a very exacting civil penalty or criminal penalty, maybe even both. Plus, there will be a greater penalty for a company who is dependent of the US government awarding contracts and they will forever become ineligible to enter into them.

It’s important to recognize the warning signs or the red flags of a potential FCPA violation. A company now needs to have due-diligence and know how to negotiate tactics to lessen the risks of doing business globally. A good example of this is a client of a company is operating in a country that lacks in compliance to FCPA regulations or that only recently has passed a comparable statute, or this client operates in a country that is known for its corrupt practices, or the client once ran afoul of the FCPA in the past and has corrected their issues, but poorly due to the misconduct of an employee and the employee is still employed. These are all red flags.

Other warning signs, which have nothing to do with the FCPA, would be the absence of a code of ethics, a reluctance to work with due diligence or a refusal to comply with future statutes. It is of extreme importance that all US companies dealing internationally understand and implement all FCPA regulations or the consequences will be grave, starting with the directors all the way down to the individual employees.

Financial institutions are not only advised to practice due diligence, but now in the United States they are required to do so by laws enacted by the FCPA, Foreign Corrupt Practices Act. The practices and procedures that are set according to the act, state that all American businesses that conduct transactions with foreign companies, financial institutions and officials, but conduct thorough research about with whom they are to become involved.

The act was written in 1977, and was in response at that time to the bribery of and by foreign officials in exchange for the opportunity to do business in any given country.  Transparency in all transactions is what the FCPA requires, which simply means that what one does, the transactions one makes, must be out in the open for all to see.

It is about enforcing the basic, and the honest telling of the truth. of conducting one’s financial, business and in some cases personal, dealings above the board and out in the open.  Everything that one does, one will be accountable for.  In the banking world, this means that all transactions are reported when deemed to be suspicious.

This has served not only to protect the institutions themselves, but has also resulted in the investigations into acts of terrorist financing and other cases of fraud and corruption.  In the corporate world, all barriers have been removed as well.  This serves to give the public easy and free access to all the information surrounding the companies with whom one is dealing with, or supporting.

It also provides the means for those companies to defend themselves if they are called upon to do so.  When everything is out in the open, with nothing to hide, innocence is just as detectable as guilt.  The same holds true in the political realm.  As officials are being held more accountable for their actions today, the lack of privacy is really a good thing.  It is good, obviously for those who are doing nothing wrong, illegal or unethical.  It ensures that those the public supports–to support them, are worthy of that kind of loyalty.  The policies of the FCPA, are just set to keep it real, and to keep it honest.

Well I have done it! I signed the contract to teach English as a second language, ESL in Thailand for an eight month period of time. I’ll be leaving in the spring of next year so I will have plenty of time to get everything in order and prepare for the years leave from home. I plan on tacking two months more time on at the end so I can spend some time seeing the country and travel around before coming home. Thailand is the land of smiles and the Thai people touted by many travelers as the friendliest people in the world. I am really looking forward to the experience to be submersed n another culture and language for that long a period of time. But more importantly is the preparations at hand.

Other than wardrobe for such a hot and humid climate and other obvious things. I am need to figure out what to do with my house. I would need to rent it out for the year I will be gone, however am not fond of the idea of meeting with, screening and ultimately selecting tenants. This is not my forte. Besides if I did that I would need to be prepared to be out of my house before I was needing to leave for Thailand. It can be difficult to keep morale up within a company in this current economic climate. It doesn’t matter what you do with your employees or co-workers, all that matters is that you give it a shot. Because right now everyone could use an hour away from their desk and the stresses that come with sitting there day after day.
